I’m posting this to let people know of a transaction I recently had with crudinyourface. The post is listed at: http://www.sr20forum.com/showthread.php?t=131699 but the story behind the postings might work to fill the gaps.

10/07/2005 my first pm to crudinyourface was on, inquiring about the AFC.

10/08/2005 the transaction was finalized on my part with funds being sent through paypal. Crudinyourface would reply to this pm.

10/09/2005 Crudinyourface marked the AFC sold on his ad.

10/11/2005 crudinyourface replied to the for sale post.

10/12/2005 I sent a pm to crudinyourface asking for a tracking number.

10/13/2005 since I had not received a replied to my request I also posted a request for a tracking number in the for sale post.

10/13/2005 I also sent another pm asking for a tracking number.

10/14/2005 Again I posted a request for a tracking number in the for sale post.

10/16/2005 Posted in the for sale post, regarding the lack of communication and lack of a tracking number. Made a deadline in filing with paypal the following Monday. At this point I believe I had been scammed, and made arrangements to pick an AFC locally.

10/17/2005 filed a complaint with paypal. Posted this fact in the for sale ad.

10/18/2005 Crudinyourface sent a pm saying that the AFC would be sent tomorrow. Replied that I had picked one up locally and was no longer interested in his AFC. At this point it’s probably just easier to defer to quotes.

crudinyourface:
The SAFC II will be sent out tomorrow, I apolgize for the wait as I have just finished a recent move and things are a little unorganized. I actually had to come home to ship it so thats why its taking so long. For some reason I wasnt able to create a shipping label with paypal either so that delayed the process. Again I apologize for the wait, it should be there by the end of the week.

I understand, moves have always been stressful with everything misplaced. I just finished a move about two months ago and I still don't have anything where I want it, I can't find half of my stuff still.

I've actually purchased another unit from someone local and will be picking it up tomarrow. I will inform paypal that I have no been in contact with you, and would like a refund of the 180 to my paypal account.

Thank you,
UltimaSE

crudinyourface:
Well I hope paypal covers that because that $180 is already spent.

I would doubt that paypal is going to cover that from their pocket, they will likely want to remove it from your attached account. Probably the easiest way would be to repost the afc and then paypal that amount back.

I'd rather this not turn into a fraud investigation as I've been through it, and while I did get my money back, it did not turn out well for the other guy.

crudinyourface:
The SAFC already went out, honestley you made the transaction and tried to cancel the sale once you learned the product was being shipped. My suggestion to you is that YOU repost the SAFC. Maybe you can make a few dollars on it since I gave you a good deal. I dont have the money and energy for this to go back and forth through paypal. I find it rude and bad business on your part to want a refund once you learned it was shipping.

I understand that this is frustrating, but given your position, I'm having trouble following you. Here's what I have:

Paypal was sent on Saturday (10-8-2005), and that was our last pm communication before Tuesday (10-18-2005). I sent you pm's (10-11-2005 and 10-13-2005) and posted in your thread (10-13-2005, 10-14-2005 and 10-15-2005) regarding a tracking number, all of which went unanswered. After a week past I had to assume I had been scammed.

After I issued a complaint with paypal (10-16-2005) you reappeared (10-18-2005) saying you'd send it the next morning. I had believed you had scammed me, and my chances of getting the afc from you was nil. During that week I stumbled upon a local sale for the same item, and given the circumstances I made the agreement to pick it up.

Given the circumstances I feel I did everything I could do. Given the benefit of the doubt that you were moving, makes the lack of communication understandable, but unfortunately does not solve the situation.

I'm sorry it has come to this, but after speaking with paypal's dispute resolution center (10-19-2005) I will be refusing the package when it arrives.

UltimaSE

Package arrived sometime this week, when it arrived I refused the package, and I jotted down the address for my records.

10/20/2005

crudinyourface:
Almost 900 posts and half a dozen seller referals and you thought you were being scammed, unbelievable. For lack of a better term I am very pissed I did business with you. I am now out over $180, inapproiate. There was NO need to file with paypal for a refund. None. Such inpatience, it had been barely a week and you jumped to the conclusion you had been scammed? I can believe this.

I decided to ignore this.

11/14/2005

crudinyourface:
Ok heres the deal flat out. That $180 was spent, I sent the package, you refused it. You jumped the gun and found a product locally screwing me royaly. I am a college student, I dont have that $180 to give you simple as that. I reposted the product soon as I reccieved it back and had no luck selling it again because of back out buyers just like yourself. As soon as it sells I can give you your money back. I'm in no financial situation to do any different. If this is a problem then maybe you shouldnt have jumped to another buyer and refused the product I sent you. What you did was ridiculous so the least you can do allow me to send the money once the SAFC sells again.

11/15/2005

I will try to explain this one more time.

Funds of $180 was sent through paypal on Oct. 8th. You confirmed with a pm on the 8th. I replied to your post on Oct. 13, 14, 16, 16, 19. I pmed you on the 12th and the 13th. That's 7 times I tried to make contact. I filed a complaint with paypal on the 17th. No communication was answered until the 18th.

A total of 10 days had past without any reply. I decided to pick the same item up locally, and file with paypal. Following this on the 18th you contacted me saying you would ship the item the next day, I informed you that I had picked one up locally and was no longer interested. After being informed this, you still decided to send the item. I refused it.

Given the situation I'd like you to think about what I could have possibly done differently? The only option I can think of would have been to wait. And after no contact for 10 days, that was no longer an option.

I understand that you are in college, I myself am still in school as well. Unfortunately, being in college does not absolve responsibility. I understand you probably have a busy schedule, but you have to understand, I do not intend to wait forever for the return of my funds. After a reasonable amount of time, I will begin pursuing further steps.

crudinyourface:
I am recieving a refund check from school hopefully next Tuesday the 28th, I should be able to have most of the $180 for you then. Thats the best I can do.

I felt I didn’t need to reply to this pm as I thought this was a good sign.

12/09/2005
With no reply, and nothing arriving in form of restitution I again pm’ed crudinyourface.

If you need some more time please let me know. At this point I have to assume that you have no intention of refunding my funds in a timely manner. That means I will have to begin taking legal steps in the hopes of gaining my funds back.

crudinyourface:
Im not going to refuse your refund, im still wanting for my check from school. Believe me, I have rent to pay so the check needs to come soon. Once its here ill send you the refund. My paypal account is useless now, so I cant send it that way.

12/11/2005

Ok, please keep me up to date.

12/23/2005

I understand about your waiting for your check and rent, I've had to deal with dispursemen checks before as well. I will wait until january 10th, that should give ample time in regards to the check, and making sure it is clear.

It has now been almost a month since your last reply. I went ahead and sent you another pm before I left for vacation regarding resolving our situation. I have not recieved a reply.

I feel at this point I am being forced to take the next step and contact the authorities regarding our transaction. While the fraudulent transaction is not enough to warrant a felony, the mistermeaner offence will affect your record and possibly even your dispursement of your loans. I once again urge you to at least contact me in regards to this dispute as I'd really rather not go down this route, it's just not really worth it to either of us.

Posted an update to the situation on the for sale ad.

And so I waited for a time. Then I began filling the paperwork out at http://www.ic3.gov/ and found the contact information for the local police. At this point I panicked. Crudinyourface had mentioned that he had moved recently and all I had was literally a login at a computer and an address he had sent the package from and a name on the package. So I plugged the name that I got off the package into yahoo’s people search, and came up with a name that seemed to match the address the package was sent from. Not only that, it also gave me two phone numbers, but the name didn’t match, so what I was looking at was likely to be crudinyourface’s parents.

So the next day I called one of the numbers, keep in mind I wasn’t threatening nor was I trying to solicit them. I was simply calling them to inform them that I was a few clicks away from getting their son in a bit of trouble, and that I honestly did not want to do so, I was hoping to obtain at least a phone number that I could contact crudinyourface at, as it seemed that he was no longer visiting the forum.

The result from this conversation was crudinyourface’s parents asked to send me a check covering the amount owed by their son. They were going to send me the full amount, but paypal had recovered about 10 dollars from crudinyourface’s account, so the amount owed was in fact 169.

A check arrived for 170. I sent the check to my bank shortly after. While waiting for the check to clear:

1/25/06

crudinyourface:
You recieved your check correct? Could you please have paypal remove that restriction, thanks.

I did not reply to this as I had every intention of removing the hold once the check had cleared.

1/29/2006
Once the check cleared I emailed paypal that the complaint had been resolved. As of checking my account today it looks like they have not resolved the hold as of yet.

There you have it, make your own conclusions.

My friend Coalition SE-L had some problems with this guy also. This guy fabbed some IC piping for him and it took forever to receive, plus he could never get ahold of this guy. Hopefully he (crudinyourface) will learn from his mistakes or maybe he won't!

I have had two poor transactions on this site. I apologize for them and don’t look to make similar mistakes in the future. I did work for Craig on two occasions; it was the second occasion that I ran into difficulty. Please if you haven’t dealt with me then please don’t make indirect comments; those who have are free to make them. I've done business with many people on this site and vice versa. As you can see UltimaSE is fairly new to this site and at the time of the transaction he has five posts on the site. His impatience is what caused this entire problem when he refused my package. Those who have delt with me know the experiences you have had and the two instances where I have problems have been unsettling and I apologize. I currently have not been doing work for anybody stemming from the changes in my life that caused Coalition (Craig) problems, which he understood. UltimaSE makes me wish the SR20 forum was setup similar to Honda Tech where new members have to have a certain amount of posts/experiences on the forum before they have access to the buyer/seller area. UltimaSE you had a bad experience stemming from YOUR decision to refuse my package. I apologize for the events that followed, but I would appreciate it if you would not continue to try and tarnish the image I have built on this forum. I am here to learn, help, and make friends, all which I have done. I am not here to steal, that I have not done.

I spent some time with Chris when he was doing the exhaust on my NX and he is a decent guy. He had a tough time recently but he is obviously trying to make up for that now. Maybe we should all just cut him a break and give him a 2nd chance? I don't think anyone here can say they never made a mistake in their past...

I wasn't going to comment on the overall transaction and simply post the pm's and time line for people to make their own conclusions, but since you've posted this I'll go ahead and point out some interesting inconsistiencies.

Fair enough, I certainly can't stop them, but if people are going to voice their opinions, we are on an open forum.

As you can see UltimaSE is fairly new to this site and at the time of the transaction he has five posts on the site.

Ok, so you're going to try to discredit me by saying that I'm new user to the internet.

I've been involved in internet commerce since 1997. I am a moderator at another forum that I have been a part of since 2000. I have been a part of this forum since 5/2003, actually two months before you. I have a low post count because I tend to use other nissan forums in an effort to supplement my knowledge of nissans, and to give me additional marketplaces to shop for parts if I need them. Additionally, I'm not sure how you have me only at 5 posts, last time I check I have an astonishing 83.

His impatience is what caused this entire problem when he refused my package.

Just so there isn't any confusion here, read the pm's. I refused the packaged after waiting without any sort of communication for a total of 10 days, and only after I filed a complaint with paypal did I recieve any sort of communication. Seeing as I already made plans to pick up an afc locally, and being a bit frustrated with how the transaction was going I told crudinyourface that I no longer wanted his. Even after this communication, crudinyourface still decided to send the package. So yes I refused it, at this point I was only interested in getting my refund in order to fill the gap I had filled locally.

Those who have delt with me know the experiences you have had and the two instances where I have problems have been unsettling and I apologize. I currently have not been doing work for anybody stemming from the changes in my life that caused Coalition (Craig) problems, which he understood.

Fair enough, life happens. Unfortunately, that does not absolve people from responsibilities. I have been more than patient in dealing with this transaction.

UltimaSE makes me wish the SR20 forum was setup similar to Honda Tech where new members have to have a certain amount of posts/experiences on the forum before they have access to the buyer/seller area.

As stated above, I've actually been here longer than you have. Post count does not equal credibility.

UltimaSE you had a bad experience stemming from YOUR decision to refuse my package.

I've had to explain this situation several times to you already. Now I find that I have to do it again. My bad experience in this transaction stemmed from your decision to not respond to any of my requests for information.

I apologize for the events that followed, but I would appreciate it if you would not continue to try and tarnish the image I have built on this forum. I am here to learn, help, and make friends, all which I have done. I am not here to steal, that I have not done.

Crudinyourface, at some point you in your life will understand that every so often we find ourselves wrong, admitting that is just a part of life and responsibility. I have done nothing to tarnish your image on this forum, in fact before this post I did not even comment my frustration with this transaction, I simply posted our correspondence and allowed forum users to make their own conclusions. I don't believe your intentions were to steal, I have never believed that, and I think if you read through some of the pm's you'll see that I made every exception possibly to err on your side.
